Village Court Rule

Rules of Village Court, 1976

Rule-1 (short name and startup)

These rules shall be called the Village Court Rules of 1976.


Rule-2 (Contrary to the subject or context, in this rule, if there is nothing wrong)

(A) "form" means the form enclosed with these rules.

(B) "Ordinance" means the village court of 1976 "Ordinance" (Ordinance No. 61 of 1976);

(C) "chunk" means any section of the ordinance schedule;

(D) "applicant" means the person making an application under section 4 of the Ordinance;

(E) "defendant" means any person against whom a person makes an application under section 4 of the Ordinance; And

(F) "section" means any section of the Ordinance.


Rule 3: (1) According to sub-section (1) of section 4, an application shall be made in writing and it shall be signed by the applicant and submitted to the chairman of the Union Parishad.

(2) According to sub-rule (1), the written application shall contain the following statements; Such as

(A) the name of the Union Parishad being proposed;

(B) the applicant's name, identity and residence;

(C) the name of the protestor, identity and residence;

(D) the name of the union in which the offense has been committed or the cause of the complaint;

(E) Nature of nature of complaint or claim, including brief description; And

(F) All the remedies which are being demanded.

(3) In relation to the first part of the application form according to this rule, the fees for the two rupees and the second part will be filed with the application for four paisa fee.


Rule 4: When the chairman of the Union Parishad rejects the application under sub-section (1) of section 4, then the application shall be returned to the applicant with the order given above.


Rule 5: (1) Within 30 days from the date of rejection, the application for revision under sub-section (4) of section 4 shall be filed to the Assistant Judge of jurisdiction.

(2) According to sub-rule (1), the application shall be signed and signed by the plaintiff. It shall be the names, descriptions and addresses of the parties, and the Chairman of the Union Parishad, who has refunded the original application, has to submit it along with this application. Whatever the reasons for the revision are being filed, it should also be mentioned in the application.


Rule 6: The person who will be applying under sub-section (2) of section 4, if he is of the opinion that the order given by the chairman of the Union Parishad is motivated or inaccurate, he has written to the chairman for accepting the application. Give the order and return it to the applicant with the same order.


Rule-7: (1) If the application is received, its details will be recorded in the registered register in Form No. and the number and year in which the case will be recorded in that register, it will also be written on the application.

(2) When a Magistrate or Assistant Judge will return the case for review, according to sub-section (8) of section 8, it shall be listed in Form No. 1 in the register and it shall be heard as a new case.

Rule 8: (1) 7 rules, the chairman will direct the applicant to appear on a particular date and time and summon the defendant for the date and time to appear.

(2) All the summons given in accordance with this rule shall be signed in two stages and signed by the chairman of the Union Parishad and sealed, and after the formation of village court, the chairman of the Village Court shall be signed and sealed.

(3) Where, in the case of a separate order, in every case, every summons given in accordance with this rule shall be issued by an officer of the Union Parishad or by any person appointed by the chairman of the Union Parishad or Village Court, in this behalf.

(4) If a person has been summoned by a summon, a summons will be issued to him personally by a wing of two-width equal to his person.

(5) On whom the summon shall be issued, each person shall acknowledge receipt by signing the opposite page of the opposite of the other.

(6) Even if it is not possible to issue a summons in the manner described in the above sub-sections, the summons issued by the summoner shall be summarized in the same manner as the case may be, and the summons issued by the summons shall be summed up in a broader section of the house and the summons are deemed to have been issued Shall be

Rule 9: (1) The summon to the protestor will be given in Form No. 2.

(2) The summons for the witness shall be given in Form No. 3.


Rule 10: After the summon is issued on the protestors, the Chairman of the Union Parishad will call the parties to nominate their members within seven days, and likewise the village court will be formed with the nominated members and chairman of the Union Parishad.


Rule-11: After receiving the names of the members, the Chairman of the Union Parishad will record the names of the members in the short column of the register no. 1.


Rule 12: (1) Where the village court, before declaring a decision in any case, Chairman of the Union Parishad, at any time, is unwilling to act as chairman of the village court for any of the reasons mentioned in sub-section (2), or any party raises questions about his neutrality, In that case, the Thana Executive Officer, the news of the Union Parishad chairman, or any pack

(3) The name of the chairman of the village court appointed in accordance with the sub-rule (1) shall be recorded in the form no.


Rule-13: After the formation of a village court, the chairman of the village court will order the defendant to submit a written objection against the application within three days and will appoint a day and time for the session of the village court and the parties to present necessary evidence in support of their respective statements. Rule-14: (1) The village court shall examine the case on the date set forth in accordance with the rules, but due to the appropriate, the court may adjourn the hearing on different occasions, but the adjournment date will not be more than seven days.

(2) The chairman of the village court will call the witnesses to swear by oath or swear the oath and write or give the essence of the statement.

(3) The village court may conduct an inquiry into any matter at any stage in the matter of dispute between the parties regarding any matter.


Rule-15: (1) In case of a case where the plaintiff does not appear on the date fixed for the hearing of the case of the Union Parishad, or in the village court, and if the Chairman of the Union Parishad or Village Court thinks that the plaintiff's case But the application for its error will be dismissed.

(2) Where the application is rejected under sub-section (1), the plaintiff may apply for the reinstatement of the case within 10 days from the date of dismissal to the chairman of the union council or village court, and if the chairman is satisfied that the applicant is present There was a reason for not being done and he did not work with Abhaila, but the petitioner's petition was rescheduled Can make a date for the hearing and a date for hearing.


Rule-16: (1) If a case is not filed in the village court on the date fixed for the hearing, and the chairman of the village court, if he thinks that he has neglected, but in the absence of the defendant, the hearing will be settled.

(2) Where a case is heard in the absence of the defendant in the case of a defendant (1) and disposed of against the defendant, in the case of reinstatement of the defendant, within 10 days from the date of the decision, the village court may apply to the chairman in writing, and the chairman Satisfied that his Haj

Rule-24: On the application of any party to the dispute, the chairman of the village court, or where there is no village court, the chairman of the Union Parishad, collecting one hundred words or fifty percent of the amount of it, any relevant document or any of the records recorded in any of the records prescribed under these rules, Provide a copy of the piece.


Rule 25: (1) Whenever any fine prescribed under section 10 or 11 is collected according to section 12, or if any fee is paid in accordance with these rules, then the receipt shall be given in Form No 6, which will have serial numbers, and its reverse part Union Parishad will be kept in the office.

(2) All the fines and fees payable in accordance with these rules shall be recorded in a register in Form No. 7.


Rule 26: According to these rules, all fees will be counted as part of the union parishad fund.


Rule-27: The serial number of the register and decree of the case and the order of the order received for each year will be given in accordance with the order of the application and in the order of decree or order given per year.


Rule 28: All documents including register of village courts will be submitted to the Union Parishad office and the registers will be reserved for up to 10 years and other documents for three years.


Rule 29: Where a money is to be collected according to sub-section (3) of section 9, the chairman of the village court will send his report to the Thana Executive Office in order to recover it as the land revenue revenue.


The order given in respect of the fine which is to be paid according to sub-section (1) of section 30: 12, shall be forwarded to the thana magistrate in the form 9.


Rule 31: The Chairman of the Union Parishad will send the return of the work of six months to the six months and 30th June respectively of the village courts till December 31, every year before February and before August 1, in the form of 10th of every year, to the Thana Executive Officer.


Rule-32: When a village court holds the opinion that it is preferable to punish the accused for the sake of the trial of a case pending in its case; Then the village court can send the case to the Criminal Court in the no. 11 form.


Rule 33: No village court will be constituted when the petitioner appeals to the applicant's claim or dispute, according to summons or otherwise, and when the demand is rejected in the presence of the Chairman of the Union Parishad.


Rule-34: When the village court or the chairman of the Union Parishad accepts any money to any party, then the money will be given to him within seven days if it is possible from the date of application of the concerned party.


Rule 35: (1) Every Union Parishad office shall have a seal of the village court, which shall be rounded and in which the names of the Union Parishad are also recorded in the village court.

(2) All summons issued in accordance with this rule shall be used in the decree, forged and other papers seal of village court.
